Only two months ago the United States Supreme Court granted GMSR’s petition for writ of certiorari in City of Ontario v. Quon. Now the Court has granted another GMSR cert petition in County of Los Angeles v. Humphries, U.S. Sup. Ct. No. 09-350. The case concerns the standards for proving a declaratory relief claim against a municipality under the federal civil rights statutes. This is the fourth GMSR case in the Supreme Court in the last four years. GMSR partner Timothy Coates, who won a unanimous victory in the Supreme Court last term in Van de Kamp v. Goldstein, 555 U.S. 335 (2009), and had previously obtained a reversal in County of Riverside v. McLaughlin, 500 U.S. 44 (1991), prepared the petition, building on work performed by partner Alison Turner and associate Lillie Hsu in the United States Court of Appeals for the Ninth Circuit. Oral argument will likely be set for October or November of this year.
