No-contest clauses and the anti-SLAPP statute both create traps for the unwary—and all the more so when they overlap. In this presentation, an experienced planner will summarize California’s current limits on no-contest clauses and to what extent it’s possible to get around them. An appellate specialist then will review how to use and respond to anti-SLAPP motions, including recent case law on anti-SLAPP motions in no-contest clause proceedings.
