Filarsky v. Delia (2012) 566 U.S. 377 (amicus)

When the Ninth Circuit ruled that a private lawyer hired by and acting on behalf of a public entity was not entitled to assert qualified immunity from suit under 42 U.S.C. § 1983 because he was not a government employee, GMSR identified the case as a likely certiorari candidate and authored the sole amicus curiae brief supporting the lawyer’s petition for a writ of certiorari. GMSR then penned another amicus brief urging reversal on the merits. The Supreme Court reversed, holding that a private individual temporarily hired to carry out a public entity’s work is entitled to assert qualified immunity. GMSR lawyers Kent Richland and Kent Bullard represented amici curiae the League of California Cities and the California State Association of Counties.
