The Court of Appeal directed the trial court to grant GMSR public entity client’s request for a protective order barring the plaintiff from designating the client’s former expert witness as an expert witness for the plaintiff, and furthered ordered the trial court to disqualify the plaintiff’s attorney based on that attorney’s ex parte communications with the witness.  This case clarifies the rules governing designation and withdrawal of expert witnesses, and it reaffirms ethical rules limiting ex parte contact with retained consultants.
