A bus rider sued the MTA for injuries allegedly suffered as a result of falling on a bus. Following a defense verdict, plaintiff appealed, asserting errors with respect to the admission of testimony by a defense expert witness. District Two, Division Five, rejected these arguments on the merits, but also found that the record on appeal lacked the jury instructions in any form and, therefore, plaintiff was not able to demonstrate prejudice, even if there had been an error.
