#23-163 Basith v. Lithia Motors, Inc., S280258. (B316098; 90 Cal.App.5th 951; Los Angeles County Superior Court; 21STCV01725.) Petition for review after the Court of Appeal reversed an order denying a petition to compel arbitration in a civil action. The court ordered briefing deferred pending decision in Fuentes v. Empire Nissan, Inc., S280256 (#23-160), which presents the following issue: Is the form arbitration agreement that the employer here required prospective employees to sign as a condition of employment unenforceable against an employee due to unconscionability?
